Builder terms

A builder is somebody who makes websites here for other people — their clients. You switch builder mode on in your account by accepting these terms; there is no application, no approval and no monthly fee. The same account works in both modes, and our ordinary terms of service apply throughout. Where these terms say something different, these win for your work as a builder.

Each client owns the site you build for them and its domain. A domain we register is registered in the client's name, never yours and never ours. A client may ask us at any time to hand their site and domain over to them directly, and we will — with a copy of the files and the domain's transfer code — whatever the state of things between you and them.

This is not a clause about trust between you and your clients. It is what makes our promise of ownership true for every site made here, whoever made it.

Partner prices apply to sites that stay on Hosting and care, with their domain registered through us. Your tier is the number of your sites on Hosting and care that are active and were paid for from your account. We count it every night.

• A new tier applies to purchases made after it is reached. Dropping a tier changes new purchases only — never a price already paid, never a plan already running.
• The discount on Hosting and care is never more than 20%. That is the cost of keeping a site online.
• A site bought without Hosting and care is sold at the ordinary price.
• A partner price and a referral reward are never combined on the same purchase.

Sites made in builder mode carry a small line at the foot of each page — “Made with You Built It” — linking to us. From the Agency tier up you may switch it off; below it, it stays.

You support your clients: their questions about their site come to you. We support you. If one of your clients writes to us, we answer them politely and point them to you — except where the question is about their ownership of the site or its domain, which we always answer ourselves.

We never market to your clients. They receive only the messages the service needs to send them — a receipt, a security notice, a notice about their site or its plan. No newsletters, no offers, no attempts to win them away from you.

You pay us, through the checkout, for what you buy for your clients. What you charge your clients, and how, is between you and them; we are not a party to it and do not collect it.

Writing credits and referral points are not money. They cannot be paid out, sold, exchanged for cash or moved to another account, and they end with the account they belong to.

A chargeback raised against us, or anything we reasonably judge to be fraud or abuse of partner prices, ends partner pricing on the account at once. Sites already paid for keep running.

In builder mode you may add your own HTML and CSS to a site. JavaScript is never allowed, and what you add is cleaned when it is saved: scripts, event handlers, links that run code and embeds from anywhere but a short list of known sites are taken out. The same content rules apply to it as to everything else on a site.

You answer for the code you add. If it breaks a page, making it right is yours to do; Care and our support cover the site as we built it, not code added to it. We may switch off added code that breaks our rules or endangers visitors, and we will tell you why.

For the personal data your clients' sites collect — messages through a contact form, bookings, orders — you (or your client) decide why and how it is used: you are the controller, and we are your processor. By accepting these terms you also accept this data processing agreement:

• We process that data only to run the service you use — storing it, delivering it to you or your client, and keeping it safe — and only on your instructions as set in the product.
• Everyone at our end who can reach it is bound to keep it confidential.
• We protect it as our privacy policy describes: encrypted in transit and at rest, access limited by account, backups encrypted.
• The companies we use to run the service are listed in our privacy policy. We will tell you before adding one, and you may object.
• We help you answer a request from a person about their data, and we tell you without undue delay if their data is breached.
• When a site is deleted, its data is deleted with it, except what the law makes us keep; backups age out as the privacy policy says.
• You may ask us for what you need to show that we keep to this, and we will provide it.

You can switch builder mode off at any time from your account. Nothing is taken away: your clients' sites keep running, their plans run to their end, and renewals from then on are at the ordinary prices. We may end the program, or change these terms, with 30 days' notice by email; a change never raises a price already paid.
